Uttar Pradesh Toughens Character Verification to Bar Violent Agitators from Public Employment

The Uttar Pradesh government has overhauled character verification rules for direct recruitment across departments, municipal corporations, councils, and local bodies, barring candidates involved in violent efforts to overthrow the established system or bring about regime change. Issued by Principal Secretary of Appointment and Personnel M. Devaraj following High Court directives, the government order formalizes and defines conduct regulations that were previously in place. The policy explicitly protects freedom of thought by stating that a person will not face disqualification based solely on political ideology. Instead, strict disqualification applies to individuals holding membership in organizations whose avowed objective is to alter governance through violent methods, a clarification introduced following recent public demonstrations in Delhi where certain groups issued calls for regime change.

Violent Activities and Serious Criminal Offences

Under the updated guidelines, the state government has instituted specific evidentiary criteria to determine active participation in violent anti-establishment groups. If an individual participates in violent regime change activities after reaching 21 years of age, and an investigation into the matter takes place within three years, authorities will treat the act as proof of active involvement. Nevertheless, appointing authorities retain discretion to review the case if positive evidence demonstrates genuine transformation in the candidate’s outlook, thinking, and conduct over that period.

The revised policy simultaneously shuts the door on candidates facing involvement in severe offences. Any applicant linked to murder, dacoity, rape, outraging the modesty of a woman, corruption, acts of terrorism, question paper leaks, or solver gangs will be completely barred from securing state employment. The government has structured these measures to ensure that individuals tied to organized academic malpractice and grave criminal misconduct cannot enter public service under any circumstances.

Protection Against Automatic Rejection

While tightening conduct criteria, the administration has laid down clear legal safeguards to prevent wrongful exclusion during initial hiring stages. The mere registration of a first information report or the pendency of a police investigation will not lead to automatic disqualification. Candidates who have secured judicial acquittals, resolved cases through mutual compromises, or undergone proceedings governed by juvenile justice legislation will also remain eligible. Furthermore, current government employees transferring to new roles will not face fresh character verification, though authorities reserve the right to obtain service records from their previous departments.

Recruiting authorities are also permitted to issue provisional appointment letters even if character verification reports remain pending. Successful applicants can join their posts by providing a formal self-declaration along with the required paperwork. If a candidate provides fraudulent information or fails subsequent background checks, the provisional appointment will be terminated immediately alongside formal criminal prosecution.

Thirty-Day Window for Police Verification

To prevent bureaucratic delays, the government has instituted a strict 30-day timeline for local police and the Local Intelligence Unit to submit verification reports to the appointing authority. The Home Department will directly monitor delays whenever reports remain pending beyond this deadline.

The revised framework eliminates door-to-door police verification, directing officials not to visit an applicant’s residence or insist on personal appearances. In instances where an intelligence report returns adverse findings, the District Magistrate must give the candidate an opportunity to present their side, either online or in person, before transmitting recommendations to the appointing department. This ensures that administrative scrutiny remains accountable, transparent, and bound by natural justice principles.
