Delayed Project Costs Builders Rs 1.6 Crore as Consumer Court Steps In

In a major relief for homebuyers, the National Consumer Disputes Redressal Commission has directed a group of real estate developers to refund over Rs 1.60 crore to a buyer after failing to deliver a flat in a Noida project.
The ruling came in connection with the housing project “Amadeus”, where the commission found the developers guilty of “clear deficiency in service.”

Case Filed After Years of Delay
The case dates back to a 2020 consumer complaint filed by buyer Kumar Gupta against M/s Saha Infratech Pvt Ltd and others.
According to the complaint, the buyer had entered into an agreement to purchase a flat in July 2014 and had paid a substantial amount towards the property. However, despite receiving payments, the developers failed to deliver the promised flat even after several years.

Over Rs 1.60 Crore Paid, Flat Never Delivered
The commission observed that the buyer had already paid Rs 1,60,17,369 out of the total agreed amount of Rs 2,38,25,625.
Despite this, possession was not handed over, prompting the buyer to approach the consumer forum for justice.

Strong Observation by the Commission
The bench, comprising AVM J Rajendra and Justice Anoop Kumar Mendiratta, made strong remarks while passing the order.
The commission stated that the facts clearly showed failure on the part of developers to fulfill their contractual obligations despite receiving a major portion of the payment.

Big Message for Real Estate Sector
The ruling reinforces the accountability of developers and highlights that delays in possession can lead to strict legal consequences.
