Historic Verdict: High Court Order May Unlock Registry for Hundreds of Stalled Societies

After years of uncertainty and legal struggle, residents of Devika Gold Homes Society in Greater Noida have finally received long-awaited relief. The Allahabad High Court has directed that property registrations of the society’s flats be completed within three months, marking a major victory for homebuyers who had paid the full amount to the builder years ago but were still denied ownership rights.
The petition was filed by society resident Deepak Dubey, along with other affected buyers, who approached the High Court after repeated appeals to the builder and local authority failed to resolve the issue. The court’s ruling has not only brought joy to Devika Gold Homes residents but has also sparked hope among thousands of flat buyers across Gautam Buddh Nagar, where registry delays have become a widespread problem.

Residents Paid in Full, Yet Waited for Years
According to the petitioners, residents had cleared all dues to the builder nearly six years ago and have been living in the society ever since. Despite this, property registrations were withheld, and several promised facilities mentioned in approved maps and brochures were never delivered.

Residents argued that if the builder failed to pay dues to the development authority, buyers should not be penalised for it. They alleged that due to an ongoing nexus between builders and authorities, lakhs of homebuyers in hundreds of societies across the district remain stuck without registries, despite fulfilling all financial obligations.

A Landmark Judgment for Flat Buyers
Welcoming the court’s decision, residents expressed relief and optimism. NEFOMA President Annu Khan described the ruling as historic, stating that it would serve as a precedent for thousands of flat buyers fighting for registry, ownership rights, and basic amenities.
“This verdict proves that homebuyers cannot be made scapegoats for disputes between builders and authorities. It gives new hope to those who have been waiting for years to legally own their homes,” he said.

Ripple Effect Likely Across NCR
Legal experts and housing activists believe the judgment could pave the way for similar relief in other stalled housing projects, especially in Greater Noida and Noida, where registry delays have affected lakhs of middle-class families.

For Devika Gold Homes residents, the verdict is more than just a legal win—it is the recognition of their rightful ownership after years of patience, struggle, and collective action.
