Noida Builder Under Fire: 29 Floors Built with Approval for 26, Buyers Cry Foul Over Wrong Possession Allotments

A major controversy has erupted in Noida’s real estate sector after homebuyers accused the developer of the Alphathumb Project, Sector-90, of constructing 29 floors despite having approval for only 26. The issue has deepened with buyers alleging they are being handed possession on wrongly numbered floors, sparking outrage and demands for a full investigation.

The Shocking Allegations
Buyers claim the builder, CBS International Project Limited, not only exceeded sanctioned construction limits but also altered floor labels during possession. Several buyers have alleged that the “ground” and “upper ground” floors in the approved plans have been manipulated, leading to mismatches between booked and allotted units.

One buyer, Sumbul Siddiqui, shared her ordeal:

“When I booked my property in 2014, it was shown as the ground floor in the plan. Now, they’re calling it the upper ground floor and giving possession on what is actually the first floor — without registration or stamp duty.”

Project Background: From 23 to 29 Floors
The Noida Authority originally allotted Plot No. 1 in 2014 to CBS International Project Limited for an IT-ITES (Information Technology – IT Enabled Services) project. Initially, approval was granted for a 23-storey structure, which was later revised to 26 floors after the entry of a co-developer in 2017.

However, buyers allege that the developer went ahead and built three extra floors, violating the sanctioned plan and bypassing regulatory restrictions.

Regulatory Questions and Authority’s Role
Despite these deviations, the Noida Authority reportedly issued both the Occupancy Certificate (OC) and Completion Certificate (CC). This move has raised suspicions of potential collusion between the builder and local officials.

Multiple notices seeking documents and clarifications were issued, but the authority proceeded to grant approvals, enabling property registrations. Buyers now question how such clear violations could have gone unnoticed.

Builder’s Defence
Responding to the allegations, Eshan Rastogi, Director of CBS International Project Limited, denied any wrongdoing:

“The building has been constructed as per the approved plan. All details are available on the RERA portal. Possession is being handed exactly as booked.”

Police Case and Legal Battle Ahead
The controversy has now taken a legal turn. A case of fraud and cheating has been registered at the Sector-142 police station, naming several individuals from the developer’s side. Buyers allege they were misled into paying full amounts for units that don’t match their original bookings.

They are demanding a forensic audit of the project, cancellation of the illegally constructed floors, and strict action against any officials involved.

Buyers Demand Justice
For hundreds of buyers, the issue is not just about extra floors—it’s about trust and transparency. Many have invested their life savings into the project, only to discover serious irregularities in construction and documentation.

“If authorities and developers can manipulate approved plans like this, no buyer in Noida is safe,” said one aggrieved investor.

A Larger Wake-Up Call for Noida’s Real Estate
The Alphathumb Project scandal exposes glaring lapses in real estate regulation and monitoring. Even with OC-CC clearance, the presence of extra floors and mismatched allotments signals the urgent need for stricter compliance checks by the Noida Authority and stronger consumer protection mechanisms under RERA.

As investigations proceed, buyers await accountability and hope this case becomes a turning point for transparency in Noida’s booming property market.
